1. Acceptance of terms

By accessing or using the Markspeed website (markspeed.ai) or any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services. These Terms apply to all visitors, users, and clients.

2. Description of services

Markspeed provides growth system diagnostics and implementation services for B2B and B2C companies. Our services include:

• The Free GSRI™ Scan — a complimentary diagnostic tool
• Tier 1 — Growth Audit
• Tier 2 — Growth System Modules (Acquisition, Conversion, Measurement)
• Tier 3 — Full Growth OS

The Free GSRI Scan is provided at no cost and without obligation. Paid service engagements are governed by a separate service agreement signed by both parties prior to commencement of work.

3. Free GSRI Scan

The Free GSRI Scan is a diagnostic tool designed to identify growth system gaps. By completing the scan, you consent to Markspeed using your responses to prepare a diagnostic report and to follow up with you about your results. The scan results are for informational purposes only and do not constitute financial, legal, or business advice. Markspeed makes no guarantee of specific outcomes based on scan results.

4. Intellectual property

The GSRI™ (Growth System Readiness Index) framework, methodology, scoring system, benchmark database, and all associated content are the proprietary intellectual property of Markspeed. All content on this website — including text, design, graphics, and code — is owned by Markspeed and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Markspeed content without prior written permission. The GSRI™ trademark may not be used without authorization.

5. Client deliverables and ownership

Deliverables produced as part of a paid service engagement — including reports, roadmaps, playbooks, and installed systems — are licensed to the client for internal business use upon receipt of full payment. Markspeed retains ownership of the underlying methodology and framework used to produce those deliverables. Benchmark data remains proprietary to Markspeed and is not transferred to clients.

6. Confidentiality

Markspeed treats all client business information shared during engagements as confidential. We do not disclose client-specific information to third parties without consent, except as required by law. Anonymized, aggregated data may be used to improve the GSRI benchmark database. Any case studies or results referenced publicly are anonymized unless explicit written consent is provided.

7. Payment terms

Payment terms for paid service engagements are specified in the individual service agreement. In general, engagements are structured with a portion due upfront and the remainder split into installments over the engagement period. Specific payment schedules, amounts, and conditions are agreed upon in writing before any engagement begins. Markspeed does not publish standard pricing on its website; pricing is discussed during the discovery call.

8. Cancellation and refunds

Cancellation terms and refund eligibility are specified in the individual service agreement for each engagement. Generally, upfront payments are non-refundable after work has commenced. If Markspeed is unable to deliver the agreed services, we will work with the client in good faith to provide a pro-rated refund for work not completed. The Free GSRI Scan is provided at no cost and carries no refund obligation.

9. Disclaimers and limitation of liability

The Markspeed website and Free GSRI Scan are provided "as is" without warranties of any kind. Markspeed does not guarantee specific business outcomes, revenue growth, or improvements in GSRI scores as a result of using our services. Our services are based on diagnostic methodology and professional judgment — results depend on implementation by the client and market conditions outside our control.

To the maximum extent permitted by law, Markspeed's liability for any claim arising from use of our website or services is limited to the amount paid by the client for the specific service giving rise to the claim.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Markspeed is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the updated Terms. For active service engagements, the Terms in effect at the time of the signed service agreement govern that engagement.
